Terms of Service

Agreement

These terms govern use of BehaviorSheets. By creating an account or using the service, you agree to them. If you are using BehaviorSheets on behalf of a school or district, you represent that you are authorized to do so, and any separate written agreement between BehaviorSheets and that school or district (such as a data privacy agreement) takes precedence over these terms where they conflict.

The service

BehaviorSheets provides tools for recording student behavior data — by direct entry or by scanning printed datasheets — and for reviewing, reporting on, and exporting that data. Scanned datasheets are read with AI assistance and always presented for human review before the data is accepted; the school’s staff, not the software, are responsible for confirming the accuracy of recorded data before relying on it for educational or clinical decisions.

Accounts

Accounts are for school staff, behavior analysts, and parents invited by the school. Students may not create or use accounts. You are responsible for keeping your credentials confidential and for activity under your account. Tell us promptly at privacy@behaviorsheets.com if you suspect unauthorized access.

Acceptable use

  • Access only the student records you are authorized by your school to access, and use them only for legitimate educational purposes.
  • Do not attempt to probe, disrupt, or gain unauthorized access to the service or its data.
  • Do not use the service in violation of applicable law, including FERPA and state student privacy laws.

School data

Student records and other data entered by a school belong to the school. The school grants us a limited license to host and process that data solely to provide the service, as described in our Privacy Policy. We do not sell data, use it for advertising, or use student data to train AI models. On request or at the end of service, we export and then delete the school’s data.

Intellectual property

BehaviorSheets — the software, design, and printed datasheet formats — is our intellectual property. Schools may print and use generated datasheets freely as part of using the service.

Availability and warranty

We work to keep the service reliable, but it is provided “as is” and “as available,” without warranties of any kind, express or implied. We may modify features with reasonable notice for material changes.

Limitation of liability

To the maximum extent permitted by law, BehaviorSheets is not liable for indirect, incidental, or consequential damages arising from use of the service, and our total liability for any claim is limited to the amount the school paid for the service in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law, or our obligations under a signed data privacy agreement.

Termination

A school may stop using the service at any time and request export and deletion of its data. We may suspend accounts that violate these terms, and will notify the school’s administrator when we do.

Governing law

For schools and districts with a signed agreement, these terms are governed by the laws of the state in which the school district is located. Otherwise, they are governed by the laws of the United States and the state of the user’s residence.

Changes and contact
